Terms of Use

1. Preamble

1.1 These terms of website use (hereinafter "Terms of Use") shall govern the use of the website of the John S. Latsis Public Benefit Foundation (hereinafter "the Latsis Foundation"), incorporated in Vaduz, Liechtenstein, having offices in Greece, 59 Diligianni Str., post code 14562, Kifissia, Athens, Greece, which can be accessed via http://www.latsis-foundation.org (hereinafter "the Website") in order to provide Users (hereinafter "the User(s)") with information on the programmes, funding opportunities and in general the public benefit activity of the Latsis Foundation.

1.2 A User’s visiting the Website, as well as filling in and submitting the relevant online declaration, shall imply that the User concerned has read, understood and fully accepted the terms herein. Therefore, a User’s remaining on the pages of the Website and using any information provided therein shall imply unconditional acceptance of the Terms of Use on the part of such User.

 

2. Use of the Website

2.1 The Latsis Foundation hereby allows the private use of any element posted on the Website, such as texts, photographs, graphics, videos, images, etc. (hereinafter collectively referred to as "the Content"), and the possibilities provided through it and consents to the printing, copying and downloading of the Website’s Content solely for informational, research, educational and in general public benefit purposes, provided that the Latsis Foundation Website is always cited as the source of the Content and that the names of the authors are stated (if they appear on the Website), insofar as the relevant intellectual property rights are not affected in any way, and without prejudice to the applicable data protection legislation. It is hereby clarified that certain files or data may be the intellectual property of third parties (partner institutions, organisations, etc.) and may not be used without their consent, which must be sought by interested parties.

2.2 The use of the Website, in whole or in part, for commercial purposes or purposes related to financial gain or for any other use falling outside the use set out under paragraph 2.1 hereof shall be expressly prohibited.

2.3 A User’s access to the Website, its navigation and the use of its Content is free of charge. However, the cost of a User’s connection to the internet shall be incurred by such User.

 

3. Amendments - Suspension of Operation

3.1 The Latsis Foundation shall be entitled to amend the Terms of Use at any time, in accordance with the applicable legislation. A User’s use of the Website subsequently to any amendment thereto shall imply acceptance of the relevant amendments.

3.2 The Latsis Foundation shall be entitled to modify the Website’s Content, add or remove information and other elements, as well as temporarily or permanently suspend the operation of the Website where such suspension is deemed necessary or advisable.

3.3 Users shall be informed through the relevant web pages of the Website with regard to any amendment and temporary or permanent suspension of the operation of the Website.

 

4. Disclaimers and Limitation of Liability

4.1 The Latsis Foundation shall make every effort to ensure that all Content and information appearing on the Website is accurate, clear and correct, updated and accessible to users. However, the Latsis Foundation does not provide any guarantee whatsoever and shall therefore not be held liable for any material damage (damnum emergens or lucrum cessans), that may be incurred by a User on account of the use of the Website’s pages or Content.

4.2 The Website is not an electronic site for the conclusion of commercial contracts, but only for access to information of an informative, research, educational and public benefit nature. Therefore, the Latsis Foundation shall not be liable for any failure or refusal to fulfil or default in respect of any obligation owed to a User by individuals or legal entities presented on the Website. Similarly, Users shall be precluded from raising against the Latsis Foundation any objection, challenge or claim arising from their relations with such individuals or legal entities on the mere grounds of the latter’s appearance on the Website.

4.3 The Latsis Foundation, taking into account the particular nature of the Internet, shall use its best endeavours to ensure that the information provided by the Latsis Foundation or by any third party is posted on the Website in full or as transmitted to the Latsis Foundation by third parties. Such information shall not be considered as advertising, whether direct or indirect, solicitation or advice for Users to take any action, whether or not resulting in financial gain.

4.4 The Latsis Foundation has taken all necessary measures, as per the applicable legislation and the relevant international practices, to ensure a high level of security and protection with respect to its own system only. The Latsis Foundation undertakes to upgrade the protection systems in respect of the Website and to use malware protection programmes. However, the Latsis Foundation cannot guarantee the absence of viruses and shall not be held liable in case of damage to equipment, software, files or other damage to the User caused by a virus.

 

5. General Obligations of Users

5.1 Users hereby accept, agree and acknowledge that they shall make lawful and appropriate use of this Website in accordance with the Terms of Use and any instructions of the Latsis Foundation from time to time posted on its pages.

5.2 Users shall be required to have installed on their computer the latest updated versions of programmes, operating systems and malware protection programmes, as well as related data and computer protection programmes (antivirus programmes, antispyware, firewalls, etc.).

5.3 Users shall be liable for any material damage (damnum emergens or lucrum cessans) incurred by the Latsis Foundation on account of their acts or omissions, as well as any action that is illegal or unfair or in breach of contractual obligations.

5.4 Users must comply with all their obligations under the applicable legislation on intellectual property protection with respect to the Content.

 

6. Hyperlinks

6.1 The Latsis Foundation has, solely for the Users’ convenience, posted hyperlinks on the Website, which lead to third party websites, the content of which is the sole responsibility of such third parties and is in no way controlled by the Latsis Foundation. Consequently, the Latsis Foundation may not be held liable for the content of such websites, since it does not monitor them in any way whatsoever nor does it maintain any relationship with their owners. Likewise, it provides no guarantee whatsoever to Users as to the quality or accuracy of the information contained therein.

6.2 It is hereby prohibited for third party websites to post hyperlinks leading to the Website without prior consent by the Latsis Foundation in writing. 

 

7. Intellectual Property rights

7.1 A User’s use of the Website and its Content shall not establish any right, interest or entitlement of that User over the works, elements and material media which incorporate intellectual property rights of the Latsis Foundation or any other party and are accessible on the Website.

7.2 Any other use other than the use referred to in Article 2 hereof shall be strictly prohibited, including, without limitation, any retransmission, publication, adaptation, release, presentation to the public, deletion, reproduction, imitation or falsification of the Website and its Content in any way, in part or otherwise, in any form and by any means. In particular, Users shall be prohibited from:

(a) Extracting or reusing all or a substantial part of the content of the Website’s database. A data User may not perform acts that are at odds with the ordinary utilisation of this database or unreasonably prejudice the legitimate interests of its owner and may not cause damage to the copyright holders or holders of related rights to the works contained in the database.

(b) Carrying out any action aimed at reverse engineering or reconstructing the source code of the Website software or obtaining unauthorised access to any software, system, individual computer or computer network and/or file of the Latsis Foundation or hacking into the Website and its systems in general, in any way, including but not limited to the use of mechanical means or automated methods.

(c) Neutralising any technological measures put in place to prevent actions that have not been authorised by the Latsis Foundation, where the User is aware of such neutralisation or where there are reasonable grounds to believe that the User is aware of the results of his/her action.

(d) Falsifying or imitating the trademark, name and other distinctive signs of the Latsis Foundation or third parties, as published on the Website. The appearance of a distinctive sign on the Website may not be construed as a transfer or licence or assignment to the User of the right to use the distinctive sign.

(e) Removing or modifying the Terms of Use or any other text in electronic form, which is posted on the Website and relates to the protection, use or ownership of intellectual property rights, whether or not the User presents part or all of the Website to the public.

7.3 In any case of infringement or in order to avert the risk of infringement of industrial property or copyright or related rights of the Latsis Foundation and third parties, including the sui generis right of the database manufacturer, said persons may, where appropriate, seek the adoption of civil, administrative and criminal sanctions against the person who has infringed or is about to infringe the aforementioned rights, in accordance with the law.

 

8. Data Protection

8.1 The Latsis Foundation only collects such personal data as strictly necessary in accordance with their intended purpose; the data are not further processed in any way that is incompatible with the purpose for which they were collected. As Data Controller in respect of personal data received through the use of the Website, the Latsis Foundation undertakes to protect privacy and provide appropriate safeguards for the protection of such data, in accordance with the General Data Protection Regulation (GDPR – Regulation (EU) No 2016/679), the Greek law, as applicable, as well as the applicable Regulatory Acts of the Hellenic Data Protection Authority.

8.2 The Latsis Foundation hereby informs Users that, acting through its officers and/or external collaborators, who are instructed by it and act on its behalf, it shall process any personal data sent to it by email or entered on the Website, as follows:

(a) Type of data: i. in case of sent emails: the data filled in by a User when sending the relevant email (including, but not limited to, the User’s email address and full name); ii. in case of subscription to the newsletter: the personal data entered in the special section of the Website (email address); iii. in case of a grant application: the full name of the representative of the entity applying for funding, his/her professional status, his/her physical and email address, his/her telephone number, as well as any data entered by the User concerned in text fields; and iv. in case of a scholarship application: all the data entered by the User concerned in the special application form for the purpose of evaluating the application and awarding the scholarship, in accordance with the conditions and criteria set out in the relevant public call (including, but not limited to, the User’s full name, date of birth, telephone number, physical and email address, academic track record, family and financial situation of the applicant and/or his/her family, etc.).

(b) Purpose of processing: i. assist Users during their navigation on the Website; ii. inform Users of any news, programmes, funding opportunities, events and in general public benefit actions of the Latsis Foundation; iii. provide grants, award scholarships and grant financial aid of any kind; iv. present and report on the Latsis Foundation’s public benefit activity; v. protect the interests of the Latsis Foundation and comply with its obligations under the law.

(c) Recipients of the data: As regards the data necessary to serve each of the processing purposes referred to above and within the scope of each recipient’s responsibilities: the Latsis Foundation, its management, employees and external collaborators.

(d) Rights of data subject: Users may at any time exercise their rights as data subjects under the General Data Protection Regulation (Regulation (EU) No 679/2016) and in particular Articles 12 to 23 thereof; more specifically, Users may exercise their right to information and access to the data processed by the Latsis Foundation, the right to restriction of processing of their data, the right to rectification and erasure and the right to data portability.

(e) Νewsletter: Users who wish to receive the Latsis Foundation’s newsletter should fill in their email address in the special form on the Website. This data will be maintained and processed by the Latsis Foundation until the User concerned communicates his/her wish to no longer receive the newsletter, either by selecting the Unsubscribe option available in each newsletter received or by sending a relevant request at [email protected].

(f) Withdrawal of Consent: Furthermore, Users are hereby informed of their right to withdraw their consent with regard to any processing of personal data in respect of which they have given their consent to the Latsis Foundation.

9. Use of Cookies

The Latsis Foundation uses cookies in order to ensure the optimal and more secure use of the Website and the information provided thereon. Cookies are small files with information that a website (in particular, the web server) stores on a User’s computer, mobile phone or other electronic device, so that each time the User visits the website, the latter retrieves this information and offers the User services related to them. Cookies do not cause damage to the device or the files stored on it and do not take note of any document or file on the device of the website visitor. 10. Applicable law - Jurisdiction

10.1 These Terms of Use, including any amendments thereto, shall be governed by Greek law.

10.2  The Latsis Foundation favours the amicable, out-of-court settlement of any dispute that may arise from the use and/or interpretation and application of these Terms of Use. Otherwise, any dispute arising from these terms and conditions shall fall within the exclusive jurisdiction of the Courts of Athens.
